Imitation vs Plagiarism

(Bernard saw a shot and jokingly remarked that Kelvin copied his idea)

Me: Imitation is the highest form of flattery; whereas plagiarism is just plain low
B: Heh heh, but the line separating the two is very fine.

(after mulling over the question for some time, and taking into context the ease of access for information and arts alike)

Me: The difference between the two is the latter's inability to reproduce said works without the presence of the creator.
